Terms of Service
These Terms of Service (the "Terms") govern your access to and use of the PDF-to-Markdown conversion service and related websites, apps, and APIs offered by pdf2mobile (the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms.
1. Who We Are
The Service is provided by pdf2mobile ("Company", "we", "us", or "our"). Contact: team@pdf2mobile.com.
2. Eligibility and Accounts
- You must be at least 13 years old (or the age of digital consent in your country).
- You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- If you use an organization's account, you represent that you are authorized to accept these Terms on its behalf.
3. Acceptable Use
- Only upload content you have the necessary rights to process.
- Do not upload or process content that is illegal, infringes intellectual property, or contains malicious code.
- Do not attempt to bypass technical limitations, rate limits, or access the Service by automated means not expressly permitted.
- Do not use the Service to create, train, or improve competing foundation models or APIs without written permission.
4. License and Ownership
- You retain ownership of the PDFs and other content you upload ("Customer Content").
- You grant us a worldwide, non-exclusive license to host, process, and transform Customer Content solely to provide and improve the Service.
- We and our licensors own the Service and all related software, models, and technology. No rights are granted except as explicitly stated.
5. Third-Party Services
The Service integrates third-party providers including Google (Gemini models and file storage) and Convex for backend services. Your use of those services may be subject to their terms and policies. We are not responsible for third-party services and disclaim liability for their acts or omissions.
6. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using the Service, you consent to our data practices as described there.
7. Service Changes and Availability
We may modify the Service and these Terms from time to time. We may suspend or discontinue the Service, or remove content, at our discretion. If changes are material, we will provide reasonable notice where practicable.
8. Fees
Paid plans renew monthly until canceled. You may cancel at any time and keep access until the paid period ends; we offer no prorated refund or voluntary money-back guarantee unless required by law. Consumers may exercise their statutory 14-day withdrawal right through the account page. If you expressly request immediate performance, a proportionate amount for service already provided may remain due. Mandatory consumer remedies remain unaffected.
9. Warranties and Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR SUPPLIERS OR LICENSORS ARE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You will defend, indemnify, and hold harmless the Company and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if required by law. Upon termination, Sections 4, 9–13 survive.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of your primary place of business if you are an organization, or your country/state of residence if you are an individual, unless the laws of your jurisdiction require otherwise. Any disputes will be resolved in the courts having jurisdiction over the Company's principal place of business, except where applicable law provides otherwise.
